Copyright Infringement Policy
If you discover any copyright infringement of your content on Phlook’s Website,
You can send a take-down notice to “Support” at info@phlook.com. Upon receipt of
a valid take-down notice, Phlook will perform reasonable steps to remove or disable
access to the infringing Content from Phlook’s Website. For a take-down notice,
you must provide us with the following information:
- Your name and Singapore address (If you do not reside in Singapore, it is preferred
that you provide us with an address of service in Singapore).
- Your contact number and email address.
- Information to enable us to identify and locate the infringing content on Phlook’s
Website.
- A statement from you that your complain is done in good faith in believing that
the content has infringed your copyright.
- A statement from you that you request Phlook to remove the infringing content from
Phlook’s Website.
- A statement that your take-down notice is accurate.
- Your physical or electronic signature and specify your right to the content that
you believe is infringing – whether you are the owner of the content or an exclusive
licensee
- Your agreement that you submit to the jurisdiction of the Courts of Singapore.
On the other hand, if Phlook has received a valid take-down notice for your content.
Phlook will send you an email of notification and a copy of the take-down notice.
You may respond with a counter-notice by sending it to info@phlook.com. Upon receipt
of your counter-notice, Phlook will take reasonable steps to restore, or restore
the access to the content (if it is still technically and practically feasible),
unless the person who has filed for infringement commences court proceedings to
prevent the restoration of the material and Phlook has been informed of such proceedings.
For a counter-notice, you must provide us with the following information:
- Your name and Singapore address (If you do not reside in Singapore, it is preferred
that you provide us with an address of service in Singapore).
- Your contact number and email address.
- Information to enable us to identify and locate the infringing content previously
found on Phlook’s Website if possible.
- A statement from you that your notice is of good faith in believing that the content
has been removed or access disabled due to a mistake, misidentification or it does
not infringe any copyright.
- A statement that your counter-notice is accurate.
- Your agreement that you submit to the jurisdiction of the Courts of Singapore.
UNDER THE COPYRIGHT ACT (CHAPTER 63 OF SINGAPORE STATUTE), A PERSON WHO IS FOUND
TO HAVE MADE ANY STATEMENT THAT IS FALSE IN HIS TAKE-DOWN NOTICE OR COUNTER-NOTICE,
HE SHALL BE GUILTY OF AN OFFENCE AND SHALL BE LIABLE TO IMPRISONMENT FOR NOT EXCEEDING
2 YEARS OR FINE NOT EXCEEDING $10,000 SINGAPORE DOLLARS. HE SHALL ALSO BE LIABLE
TO THE DAMAGE OR LOSS INCURRED BY ANY PERSON AS A RESULT OF THE NOTICE.
